THE APPEAL COURT OF KYIV
The history of the Appeal
court of Kyiv was begun in 1975, when The Kyiv municipal court was created as
the regional court by the Decree of the President of the USSR Verkhovna Rada Presidium "On
the creation of and the Justice Department of the Kyiv City Council Deputies
workers executive Committee" from May, 30, 1975. Iuriy
Mac´ko was chosen as the Chief Justice
(1975-1978).
The Kyiv municipal court
was acting in the complement of the Court Presidium, Judicial Panel on Civil
cases, the Judicial Panel on Criminal cases. In the
frameworks of its power the Judicial Panels on Civil and Criminal cases
examined the cases as the court of first instance in cassation since the
discovery of the new facts had been founded. Also the Kyiv municipal court
observed and generalized the jurisprudence, analyzed the judicial statistics,
exercised its powers, given to it by the legislation.
On 11 October, 2001 the
Kyiv municipal court was renamed as the Appeal court of Kyiv by the Decree of
the Chief Justice Hryhoriy Zubets´.
In 2003 Hryhoriy Zubets´
resigned.
On 12 February 2003 Anton Chernushenko was appointed as the Chief Justice of the
Appeal court of Kyiv.
Nowadays the legal status
of the Appeal court of Kyiv is defined by the Law of Ukraine "On the
judicial system and the status of judges" from 07 July, 2010. The Appeal
court of Kyiv is acting in the complement of two judicial panels: the Judicial
Panel on Civil cases (the Chief Victor Kachan) and
the Judicial Panel on Criminal cases (the Chief Mariia
Pryndiuk).
As at 01 January 2010 98
judges are working in the Appeal court of Kyiv.
In 2005 the Appeal court of
Kyiv with the V. Koretskiy Science National Academy
Institute of the State and Law established the new scientific practical journal
"Judicial appeal", which has been published quarterly. In the Journal
the questions of criminal law and criminal process, civil law and civil
process, economic and administrative proceedings, jurisprudence and scientific
chronicles are enshrined.
The Appeal court of Kyiv
cooperates actively in the sphere of international relations with the different
states, among them are: France,
Canada, Germany,
Switzerland etc.
